The e-commerce website of Vero [Ochahlii Mineralshop], a private limited company with its registered office at Kloosterstraat 4, 8421 Vlissegem, VAT BE 0475397790, RPR Bruges, offers its customers the opportunity to purchase products from its online store.
These General Terms and Conditions apply to every order placed by a visitor to this e-commerce website (“Customer”). When placing an order via the online store of ochahlii.be, the Customer must explicitly accept these Conditions, agreeing to the applicability of these Conditions, to the exclusion of all other conditions. Any additional conditions of the Customer are excluded, except when previously, explicitly, and in writing accepted by the management of Vero bv.

All prices mentioned are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Customer.

The price stated refers only to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.
**Article 3: Offer**
Despite the fact that the online catalog and e-commerce website are compiled with the greatest possible care, it is possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Vero bv. Vero bv (Ochahlii Mineralshop) is only bound by a best-efforts obligation for the correctness and completeness of the information provided. Vero (Ochahlii Mineralshop) is in no way liable in the event of manifest material errors, typesetting, or printing errors.

**Article 4: Online Purchases**
Products added to the shopping cart can be paid for by first creating a login or via an anonymous purchase. Once the payment is completed, the customer receives a confirmation email of the purchase. Once the product is shipped, the customer is informed by email, including the carrier's tracking code to follow the package.
The Customer can choose between the following payment methods:

Vero bv (Ochahlii Mineralshop) is entitled to refuse an order due to a serious shortcoming of the Customer concerning orders involving the Customer.
**Article 5: Delivery and Execution of the Agreement**
Articles ordered via this online store are delivered within the EU.
Delivery is carried out by carriers such as Bpost, DPD. The costs depend on the prices charged by these third parties. For Belgium, the shipping cost is €12 per package.
Unless otherwise agreed or expressly provided otherwise, the goods are delivered to the Customer's residence within 30 days of receiving the order.
Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery must be reported immediately by the Customer to Vero bv (Ochahlii Mineralshop).
The risk of loss or damage passes to the Customer from the moment he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods. **Article 6: Retention of Title**
The delivered articles remain the exclusive property of Vero bv (Ochahlii Mineralshop) until the moment of full payment by the Customer.
The Customer undertakes to inform third parties, if necessary, of the retention of title of Vero bv (Ochahlii Mineralshop), for example, to anyone who would seize the articles not fully paid for.
**Article 7: Right of Withdrawal**
The provisions of this article apply only to Customers who, in their capacity as consumers, purchase articles online from Vero bv (Ochahlii Mineralshop).
The Customer has the right to withdraw from the contract within 14 calendar days without giving any reason.
1. The withdrawal period expires 14 calendar days after the date on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the goods.
2. For contracts where the Customer has ordered multiple goods in the same order which are delivered separately: "on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the last good."
3. For contracts for the delivery of a good consisting of multiple shipments or parts: "on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the last shipment or the last part."
To exercise the right of withdrawal, the Customer must inform Vero bv, Kloosterstraat 4, 8421 Vlissegem, Belgium, with company number BE0475397790, by an unequivocal statement (e.g., in writing by post, fax, or email) of his decision to withdraw from the contract. The Customer may use the attached model withdrawal form, but this is not obligatory.
If you allow the consumer to submit information on the withdrawal from the contract electronically via your website, insert the following text: "The Customer can also fill in and submit the model withdrawal form or any other clearly formulated statement electronically via our website www.ochahlii.be. If the Customer uses this option, we will send the Customer a confirmation of receipt of the withdrawal on a durable medium (e.g., by email) without delay." To comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return or hand over the goods without delay, and in any case no later than 14 calendar days after the day on which he has communicated his decision to withdraw from the contract to Vero bv (Ochahlii Mineralshop), to the following delivery address: Ochahlii Mineralshop, Leopoldplein 1a, 8420 De Haan, Belgium. The Customer is on time if he sends back the goods before the period of 14 calendar days has expired.
The direct cost of returning the goods is borne by the Customer.
The Customer is requested to return the articles in their original condition and packaging, with all accessories supplied, and instructions. If the returned product is in any way reduced in value, Vero bv (Ochahlii Mineralshop) reserves the right to hold the Customer liable and claim damages for any depreciation of the goods resulting from the use of the goods by the Customer that goes beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
All returned articles are carefully examined. The principle is that the consumer may only inspect the article as he would be allowed to do in a shop. Returned articles may have been tried on, but must not have been used. When an article has been depreciated due to the use of the Customer, this will be charged to the Customer. The safety tag must always be attached to the product in its original form, i.e., the tag intact.
If the Customer withdraws from the contract, Vero bv (Ochahlii Mineralshop) will refund all payments received from the Customer up to that point, including the standard delivery costs, to the Customer within a maximum of 14 calendar days after Vero bv (Ochahlii Mineralshop) has been informed of the Customer's decision to withdraw from the contract. In sales contracts, Vero bv (Ochahlii Mineralshop) can wait with the reimbursement until it has received all the goods back, or until the Customer has demonstrated that he has returned the goods, whichever comes first.
Vero bv (Ochahlii Mineralshop) will refund the Customer with the same payment method as the Customer used for the original transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not be charged for such reimbursement.
The Customer cannot exercise the right of withdrawal for:
- the delivery of goods manufactured according to the Customer's specifications or which are clearly intended for a specific person;
**Article 8: Warranty**
Under Article 1649quater of the old Belgian Civil Code, the consumer has legal rights. This legal warranty is two years and applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.
To invoke the warranty, the Customer must be able to present a proof of purchase. Customers are advised to keep the original packaging of the goods.
For articles purchased online and delivered to the Customer's home, the Customer must contact the customer service of Vero bv (Ochahlii Mineralshop) and return the article to Vero bv (Ochahlii Mineralshop).
In
the event of a defect, the Customer must inform Vero bv (Ochahlii Mineralshop) as soon as possible. In any case, any defect must be reported by the Customer within 2 months of its discovery. After this period, any right to repair or replacement expires.
The warranty (commercial and/or legal) never applies to defects arising as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or the manual, modifications or alterations to the article, rough handling, poor maintenance, or any other abnormal or incorrect use.

**Article 10: Penalties for Non-Payment**
Unless otherwise agreed explicitly and in writing, the invoice is payable in cash. In case of non-payment of the full or partial price on the due date, the provisions of book XIX of the Code of Economic Law apply, and the seller will send the customer a free reminder to pay the outstanding amount within 14 calendar days. If the customer does not pay within this period, the outstanding amount will be increased by an annual interest calculated at the reference interest rate increased by eight percentage points referred to in Article 5, second paragraph, of the law of 2 August 2002 on combating late payment in commercial transactions calculated from the calendar day following the day on which the free reminder was sent to the customer, as well as a flat-rate compensation of:
- 20 euros if the outstanding balance is less than or equal to 150 euros;
- 30 euros plus 10% of the outstanding amount on the tranche between 150.01 and 500 euros if the outstanding balance is between 150.01 and 500 euros;
- 65 euros plus 5% of the outstanding amount on the tranche above 500 euros with a maximum of 2000 euros if the outstanding balance is higher than 500 euros.
Without prejudice to the foregoing, […] reserves the right to take back the unpaid (fully) articles.
